What happens to my income tax refund if I haven't received it yet when I file bankruptcy?

If you are entitled to a tax refund and do not owe back taxes, you will be entitled to keep your tax refund as long as the amount of the tax refund does not total more than your allowable personal property exemption taking into consideration all of your other property. In additional to application of the "wild card" personal property exemption, you can keep all of a refund which is attributable to the Earned Income Credit (EIC) or the Additional Child Tax Credit.
